my newphew had to stay behind at school for dention to 5pm trying to find out if this is with in the law please help !!!!

he has just started high school so he is 11

I think it is ok if they gave your nephew's parents 24 hours notice (though 5pm seems to be quite late - what time do they finish school?).
They need to give notice as stated above, otherwise parents up and down the land would be reporting children missing.

the school finishes at 3.30pm and she got the phone call on thursday morning for that after noon
Not sure on the legalities of the situation but she must have agreed when they phoned her.

But then his mother must have agreed to it during the call so should just make a note should it happen again
As has been said , with notice to the parent acceptable . Personally , I find the idea of detention quite worrying. To keep a child behind when friends and other children have left for home, school transport may have gone , darker evenings approaching , not a good scenario-- but my view only.
At my high school, if they wanted to keep you behind for more than ten minutes, they had to tell your parents more than 24hours in advance.
Will the boogie man get them on the way home? Or do paedophiles multiply when it gets dark?
Put this within the perspective of what the dear child has done wrong, and how willingly he accepted his initial reprimand for having done it. Typically:
That was naughty - I want to see you for 10 minutes this breaktime (doesn't show up).
Why didn't you show up (forgot) - OK make sure you come to me this lunchtime (doesn't show up)
Locate child in afternoon lesson - you have the option to stay with me for 10 ins after school or half an hour tomorrow - i have your letter ready here (takes letter. Doesn't show up next day)

So you get the picture? Often the child has occupied hundreds of pounds of teacher time by the time he can be made to accept the consequence of his behaviour. It would help to have family support, rather than criticism and undermining, in these circumstances.
Course if the school's making a mountain out of nothing then billhooks to 'em, get 'em sued.
