Flexible working hours

If two employees perform basically the same function, however one has been given dispensation for 'flexible' working hours (i.e. arriving earlier, leaving earlier - not different hours of work) does that have to be extended to those in the same capacity?

No. Its driven by the individual employment contract between the employee and the employer, or by individual discussion by the two parties to come to a local agreement based on individual circumstances. If you believe your circumstances merit it, why not ask.

Adding to Buildersmate�s answer (which is quite correct): the most likely reason that these flexible hours were granted to the other employee is because they have a child to drop off at and collect from school. That right is covered by legislation that many companies will have turned into a company policy. The first link below will take you to an interactive site were you can work out if you�re eligible or not. The second link takes you to the Dti guidance on the right to ask for flexible working. You should also look at your company�s policy which should be freely available to you.

our working hours are 9.00 - 5.30, however i have been given dispensation by my boss to start at 8.45 and leave at 5.15, this enables me to get a bus home without having to wait an hour.

Thanks guys - I was asking in the hope that if applied to one worker the results would be blanket applicable but obviously not. Thanks for your time.
