Me and my partner live in my parents house for 15 years now they want me out in the past on numerous occasions they have promised me and my partner the house but nothing on paper
The deeds are in there name and we have never paid any rent or mortgage but we have spent money on the property over 10 years about 15k . Do I have any chance of keeping the house or staying here we have 2 children the solicitor had advised me of estoppel saying that you parents have broken there promise?Additional DetailsI forgot to mention me and my husband are separated know he is saying that no promise was made I have a witness to the promise but we did apply for local housing housing register waiting for a house will that have any significance ?
As the landlords are saying one of the conditions of staying there was that you stay on the hosing register.
In other words we did not reply to our detriment can this act bee taken like this ?

Exactly, Tiger - you sort it out before you divorce, to prevent all this dirt being dished afterwards. Read what you've pasted: you will lose important rights to make any claims on property or finances. The property doesn't belong to your ex, so you can't claim from him. You haven't divorced your in-laws, they are nothing to do with it. They've been more than...

Before decree nisi got eviction notice
Yes, absolutely I am - where you live with your children should have been a vital part of the split arrangements, shouldn't it?
Question Author
Thinking of it know yes ok got you
No wonder ex dis not full in form e as he thought house was not his
...and it still isn't his. Go and see your solicitor, print off this thread and take it with you if it helps.

On the intention to proceed with a financial order it has one box a property adjustment order I should have ticked that and sent it to my ex
Question Author
If it's not his why am I going to court
Only you can answer that question Tiger.
You tell me, Tiger - you know it's not his, you said so - the house belongs to his parents. I thought that you were going to court to get occupancy from his parents on the grounds of this alleged promise. If you don't know why you're going, after all this, then I guess none of us can help you.
Ask citizens advice bureau. CAB can help with re-housing if necessary.

Even if i did fill In the financial order while I was still married I still think I would have got nothing
I know this has been asked but I may have missed your response, did you have the assistance of a solicitor whilst going through your divorce proceedings?

If so I am at a loss to understand how this issue was overlooked.
Question Author
Yes I did
Then I am at a loss to understand how you can be in you current situation.

Good luck.
and Eccles cake - the next one please

If you are evicted and you have children under 5 then the local council is bound by law to rehouse you. The C A B will help and will also assist in the run up to and the court hearing for the eviction order.

Alot of the advice on what the divorce settlement should or should not have invovled or settled is not that relevant at this moment

Been thinking all day what to do
If you have saved enough from your cheap rent to rent somewhere else, start looking straight away. If you can't afford to privately rent/have very young children, then go to the nearest housing association with your eviction notice. I assume you've already told whichever housing register you're on that you're about to be evicted?
Rather than thinking, you should have gone to the CAB today for help in finding somewhere else to live.
This is all very desk-toppy innit ?
