Power Of Attorney

We have been advised by my mams GP to obtain Power of Attorney asap , I haven't a clue where to start
Can anyone give me any advice please ? Do I need a solicitor or can I do it myself ? Thanks

I'm in the process of this at this time Jasmin, it is not as straight forward as it appears, there is a cost of £400 in the process, I have to get a GP's written letter £90, my Mother is first stage Dementia, every possible detail has to be correct including, ' . , If you are a person that can handle stress you will be ok, if you can not, think about a Solicitor.

Is that £400 to do it your self ? Or is that with a solicitor ?

My brother & I are doing this at present for my Mum. She is OK at the moment 78 years old and fully functional. But it was her idea and correct. The website in my opinion is not that daunting it is only the same as a solicitor would do. It is the emotion involved that is and the realisation that your parent is on the way out. What has been particular difficult for us is that Mum does not want to be resuscitated should anything happen. I can understand this but you still have to bear it.

The charge to register an LPA is £110 (but remember that you might need two LPA's; one to cover 'health and welfare' and another to cover 'property and financial affairs').

However there's no fee if your mother is in receipt of certain means-tested benefits or a reduction of 50% if her annual income is less than £12,000. It's all in my link).

Jasmin, when you apply to the High Court in London there is a fee of £400 they are very quick to request that, if you do intend to go through the process get yourself an ex--pence book & book every single thing, & I mean everything that's involved your Time / Petrol / Stamps / Phone Calls , everything. Wolf I started the Process myself & found it very trying, I am up to the stage of Court Of Investigation as a Brother of mine has been stealing my Mothers Money Into the Thousands, slowly I am getting there, I am now waiting for the Court Of Protection order, this will give my Access to my mothers Account, to what I have said, " they are very quick to request the £400 but not very quick there on, going for the P.O.A. is in my experience a pain, you are up against the Data Protection Act from all areas. TWR - you are not talking about Power of Attorney, but Deputyship, which applies when the donor has lost capacity - and yes is expensive

If the donor knows what the are doing a Lasting Power of Attorney is cheaper and simpler and less rigorous

Wolf 63 - enduring powers of attorney are obsolete - it's a Lasting Power you should consider
