Hello everyone,

I need some help.. We got civil partner 9 years ago and we have upgraded to marriage recently but we have never changed our names.

My wife is Portugeuse and I am British, and as per normal Portugeuse names they are quite long so we have finally decided to join our names by using one of my wife's surnames and mine to form a new name. So we have to go through the deed poll process, but my question is - will this be legal in Portugal? Will they accept it? Can she the go back tonportugal and have no problems changing her ID card and passport!

I've phones the deed poll services and they said contact the Portuguese embassy and we have and they didn't have a clue can anyone help?

Thank you in advance.

There is a Portuguese equivalent of name-change by deed-poll, so I would have though that the answer would be for you to change your name in the UK, and your partner to change her name in Portugal. Same-sex marriages have been recognised in Portugal since 2010

If the Portuguese Embassy do not know I would be surprised if anyone on here can help. Can your wife phone the Portuguese passport office in Portugal and ask them?
Sorry to ask, but are you in a 'same sex' marriage and if so are such marriages recognized in Portugal ?
Found this

From this it looks as if a same sex marriage preformed abroad has to be 'Transcribed'. by the Portuguese registry service before it is recognized in Portugal. So it looks to me that you have to travel to Portugal and get the marriage registered there first, I am open to correction though.
It must have been a same-sex marriage, Eddie. Civil partneerships are not available to mixed sex couples.

Sorry, I don't know the answer to your question, JDW, but this made me wince:

"...and we have upgraded to marriage recently..."

You make your marriage sound like a bank account or a flight to the sun:

"I have upgraded my current account to a premium product that gives me free travel insurance". Or "We were upgraded from economy to business class".

Ouch!

^^100% agree NJ, I was sure it was a same sex marriage for the same reason.
'Upgraded' made me think they were treating it like getting a new car as well!
Further to Eddie51's second answer, yes for the marriage to be recognised in Portugal, you would need to get it transcribed there, but (although it's your marriage that drives your desire to change your name) there need be no direct connection between the marriage and the name-change. In both the UK and Portugal, anyone may change their name - you don't need a reason.

Hi

Thank you all for your speedy replies..especially you Eddie51.

Yes marriage is same sex, and I didn't mean to sound flippant with regarded to demeaning the original civil partnership it just our own way of saying we have now got married - but let me assure you it doesn't take it away from how we feel and what our marriage means to us.

Thanks again for speedy replies and when we next go tonportugal we will go to the civil offices with all our paperwork from our marriage.

Thanks all
Do as 'The Chair' says and then get your marriage 'transcribed' and there should be no problem.
