can I legally smoke an Electronic cigarette in all public places? knowing this government and the possible loss of tax revenues they will disregard the massively reduced health risk to smokers who dont want to quit and come up with excuses to stop it.
Why not leave it up to the individual business/ local government to decide.
This invention could take off in a big way and I know there will be objections.
The relevant legislation states:
smoking refers to smoking tobacco or anything which contains tobacco, or smoking any other substance
and
smoking includes being in possession of lit tobacco or of anything lit which contains tobacco, or being in possession of any other lit substance in a form in which it could be smoked.
My understanding of the way that nicotine is released by electronic cigarettes doesn't involve anything being 'lit', so it's possible that they may fall outside the scope of the legislation.
I think you can because it will not pollute
