Punishment for section 18
57 Answers
Basically my boyfriend was in a pub and went to the toilet with his friend, they were both in a cubicle when someone tried to enter and was accusing them of taking cocaine (which they have told me they weren't), the person turned out to be a police CID officer but he didn't tell them this.
He tried to get to our friend but my boyfriend stopped him, the officer then hit my boyfriend round the mouth, he then retaliated and punches were thrown from both ends, our friend tried to split them up but failed so walked out the pub. My boyfriend then pushed the officer off him and turned around and walked out.
It turned out that he hit the urinal when he fell which punctured his lung.
They didn't find out he was a police officer till the following day.
There is no evidence of drugs apart from what the policeman has said.
My boyfriend has no criminal record and the behaviour is completely not like him.
I'm really worrying what will happen!

Being a bloke, even I'd be worried if two men were in the same cubicle together - regardless of the door being open. Us blokes just don't do that sort of thing, it's not like women where we go to gossip or whatever. It sounds to me as if they were up to something and my first guess would be drugs. My own limited knowledge is that they use the ceramic top of the cistern to 'chop up' the cocaine and then sniff it up with a rolled banknote or paper. The ceramic surface ensures none is wasted.
Section 18 In UK Law could mean a variety of things However Usually "A section 18" as a term relates to A Section 18 Premises Search carried out by police officers when someone is held in custody on suspicion of a crime and there is reasonable suspicion that if the suspect is released and a warrant is applied for (which generally takes 2 days or so) then evidence of the crime will be lost
The Duty officer in these circumstances can authorise Police officers to attend the address and search the property for items to do with that crime. the occupiers at the address will be given a form with the powers of entry on which will be signed by the search manager and all officers on the search would be listed. on this. any property found is logged in a search record book (Book 101) and signed by any occupant present. all seized items are to be bagged and tagged at scene and the seal numbers placed in the search record.
In reply to your earlier comment that they're 'scruffy' boys so they couldn't possibly be gay - you're having a laugh aren't you or just deluding yourself. It's highly unlikely - possible but highly unlikely - that a police officer is going to make something up for no reason is it?

section 18 wounding with intent.
Whatever about being gay, they aren't.
And yes the copper would make it up he's known for being a drunk idiot, the week previous he'd tried to start a fight with 7 local rugby lads, it was also the anniversary of his sons death and was drunk so would obviously be upset.
It wouldnt really look good if he'd told his boss that he entered the cubicle on suspicion of them doing drugs, then there was no evidence would it- he has to say they were deffo doing it for his own skin

I know its bad, but the police never said I'm a police officer, its only when they were arrested they were told he was in the police. When arrested they were told it would be treat as if the officer was a normal joe bloggs person because of this.
It isn't like him at all, if someone tried to get to your mate and hit you in the face would you just stand there, or would you hit him back??!

See, the problem is that you definitely defend them/him on the grounds that they are not gay and that's fair enough, but your lack of defence about the drug taking makes me, and probably the police, think that they must have been in there for drug taking - like I said, men do not go into toilet cubicles together for no reason.

Has any one asked the question. Was the copper actually on duty at the time this would make a hell of a difference?
Your boyfriends solicitor can request a copy of the duty roster.
p.s. krustyman that wouldn't apply as they were in a public bar and the police have a legal right of entry if they believe a crime is being committed on licenced premises
