I was arrseted and charged with a section 20 gbh charge how it happend was i was in a que at mcdonalds where i was enployed waiting for food when a guy walked in who jad been given me hassle for weeks he had been comin into macs shouting to me hes a known knife carrier he came over to me and said get outside i want a fight i told him to behave but he carried on then left he came back in again 5 mins later and started again as i walked out he punched me so i pulled out my batton and smashed open his skull now i know im in the wrong and im not going to try to get away with it but he was warned prior not to mess with me or my family but he continued to is this right if he was driving and saw a sign saying donot pass road is out then he wouldnt pass so when he was warned why did he contue to harras me the police wont listen to my harrasment case they just want to get me charged i just wanted to ask advice on this thank you for taking the time

yeah true but why does he try to live the life of a thugf walk the streets with a knife run with a gang of lads then when he as bitten off more than he can chew runs to the police he was warned and if he had come to me as a friend and talked we would of sorted it never mind maybe he will learn to choose his path in life

the reason i say they should no me is im a amature boxer so why did he still come wanting to fight i can never understand people when they are told something why do they not listen

If you're an ammateur boxer then why didn't you rely on your power and strength rather than a batton?
I'm not saying you should have hit him, but hitting soemone with a batton is a more serious crime.

So when the police arrested you was it at the crime scene or a later date? Did you say he had a knife-get them to check him?

I don't know it sounds a bit suspicious, you should have reported it, espcially as worried you that much that carrying a batton..

if i had used my hands the police said i would be in more trouble as they are classed as deadly weapons and no they never checked him or anything they wasnt intrested they wanted me they got me straight away i should of called the cops when he was following me ect but i made the wrong choice

This has got to be a windup.

It is ALWAYS far more serious if you are carrying or use a weapon - after all, your hands are always on the end of your arms.

It is an offence simply to be carrying a weapon in public.

I'm sure that in your own mind you were right, but the fact that you went outside as an invitation to fight, and then used a weapon which you had concealed on your person will not go down well in the eyes of the law. I have a lot of criminal court experience, and you really should expect a prison sentence on this one ! You can't use a counter-claim of harrasment as an excuse for serious assault / gbh, and the time to do something about your claim was PRIOR to this incident.

This happened at work..? Why not call the police the first time he came in.
