can i be evicted?
4 Answers
Hello to all who read,
my problem is this i have moved into a house in early april this year.
Both myself and my partner are on job seekers allowence, we only get 100 pounds per forthnight.
Our rent is 100pounds per week, housing executives have agreed to pay 76 pound per week leaving us with the rest to pay.
But my problem is not with housing executives.
My problem is with my landlord!
At first my landlord asked me who would be paying my rent i told him it would be housing executives he said he didnt have a problem with that once he got his rent.
I gave him one months rent which was 400pounds,
he agreed to wait untill my claim came through before i could give him a 400pounds deposit.
Yesterday i received a text from him saying he wanted 800 pounds by the end ot this week and also another 400 by the end of next week,!!!
(400 was for my deposit and 400 for this months rent) (the other 400 is for the month of june)!!
I told him i couldnt get all that money and he went mad!!
I then contacted my executives office and they saiid they would be paying all the rent my back dated rent by the end of next week!
they even rang him and told him the same!
i am full prepared to pay and outstanding amounts ther after that.
But now my landlord has told me to pack our bags and "FXXX" off!
Today we changed the locks on the doors!
Can anyone please give me advice on anything got to do with this issue!!!!!!!!!!
eg am i entitled to change my locks also can he kick the door in?
If this went to court what you think may happen?
any other advise will also be took on board!!
thanks to all who take the time to help

2. Most tenancies say that rent is due monthly in advance, so effectively if most of your rent is paid by housing benefit you are always in rent arrears. Responsible landlords understand this and accept it - they know that the rent is more likely to be paid without problems if they are getting it (or most of it) from the local authority.
3. If you have a normal assured shorthold tenancy the landlord cannot evict you without a Court order. Any attempt to do so is illegal and a criminal offence.
4. Go to your local CAB for more detailed advice.

Sounds like your landlord owes money to somebody and hasn't got good control of his finances. Are you in England? You can probably keep the locks changed and squat the property for ages if you keep it occupied. You can get advice on squatting on the internet if you look for it. You should also be able to get an early payment but the idiots that work at your housing office won't tell you about it unless you ask, can't remember what the official name for this kind of payment is but they might be able to help if you ask for it, possibly called an interim payment? Hope you get it sorted out!
