Can this man not be arrested for exposing himself?

Recently a neighbor has started having showers and when he comes out he dries himself in the curtainless window clearly where the whole street can see him. This has only started when a couple of young (Over 21) polish girls have moved across the street as they all use to drink outside till the early hours and i think this sicko does this to try and impress the girls or gets his sexual thrills from exposure. He knows that he's doing this as he comes out of the shower clearly aroused and he has had numerous anonymous letters telling him people were not happy about this. I have now decided enough is enough and will be consulting the citizens advice beureau the police and and legal advice. Can i ask could I be arrested for taking video footage of him naked to be used as evidence?

I'm with ummmm, speak to your local police station and see what they advise. If he is doing it that often then I'm sure they could try and see for themselves rather than you having to risk further problems by videoing it.

Yes I understand your advice of phoning but then I have to mention that I have video proof and if that's illegal and I then wipe the recording then the police will have the call logged and recorded and I'd be arrested which is what I'm trying to avoid.

I didn't mean lie and make him out to be a paedophile, just thought it might be a little more persuasive for the police to act sooner if it is affecting groups seen as more vunerable to being offended by it and it being more inappropriate in front of such as women and children.

Redcrx as I wanted to take the video camera with me then getting rid of evidence in front of a policeman is a criminal offence the last time I checked. Society If you seen this guy then you would know that no one on earth would want to see him naked on purpose.

As has been mentioned, the offence of “Exposure” is covered by section 66 of the Sexual Offences Act 2003. The section is very brief and succinct. It states:
A person commits an offence if—
(a) he intentionally exposes his genitals, and
(b) he intends that someone will see them and be caused alarm or distress.
There is no need for the offence to be carried out in a public place. For a successful prosecution it will have to be proved that he exposed himself intentionally and that he intended someone to see him and be caused alarm or distress.
From your description I think the main issue to be overcome will be whether or not he did what you say. It will be that of his intention to cause alarm or distress. If, as you say, his actions are directed towards the Polish girls it may be very difficult to prove that he intended them to be caused alarm or distress. Although it may be clear that other people are being caused alarm or distress it might be tricky to prove that he intended them to be so affected.
