I'm not sure what you are asking, Tora. Which precedent are you referring to?
The mental patient was different - he'd been committed to the institution and couldn't walk out of it. Smokers can't be compelled to go to hospital. Their options might be pretty limited and unattractive, but they do have options, unlike the mental patient.
We can't smoke on the grounds of the hospitals around here. Although people still do.
I'd have thought it would be very difficult to enforce for patients and potentially put inpatients at risk by them trying to sneak out for a crafty cigarette out of sight, going off site or hiding somewhere, without knowledge of medical staff.

I also imagine it may cause additional security issues, especially late night at A&E, security officers have enough problems without trying to enforce a non-smoking policy, especially with some patients or family members. It also leads to a potential problems if sick people are sent off site.
Our local Hospital (Royal Bolton) in an effort to try and stop people congregating under door canopies etc, put it to the Public vote as to whether to reinstate Smoking Shelters for the grounds. The results were albeit only marginally in favour of reinstating them , the Hospital bought them and then decided to go back on their promise and have now sold one on E Bay and may use the others to cover th Pay and Display machines in Car Parks.

I don't see many rushing to the Court of Human Rights - just ignoring the ban as before.
