The point here is that if this deportation was allowed it would mean that the law is different for someone born 'out of wedlock' ( a ***!) than for someone who's parents were married. It is the 'point of law' that is the crucial factor here NOT the details of this specific case.
We do not discriminate against someone who's parents were not married in any other situation so we can't do so in this case.

One would not be treating him differently because he is a barsteward, we would be treating him differently because he opted not to apply for British citizenship before he was 18.
To block deportation is therefore allowing him to 'have his cake and eat it' since he is Jamaican when it has suited him and now 'honorary' British when to be so benefits him.
It looks like blatant discrimination to me. Maybe other Jamaicans living here can claim it isn't their fault that they are Jamaican not British if caught doing something they ought not and threatened with deportation.

OG, the point is that if his parents had been married he would not have needed to apply for British Citizenship, it would have granted been automatically .

But that is not the point, that is an irrelevance. One could always argue that if one wasn't Jamaican then one wouldn't need to apply for citizenship regardless of who one's parents were. Whether they were married or not should not be a factor. It's been claimed/made a factor in order to try to justify a strange decision.

As I keep saying the point is that as he had a British parent if they had been married he would have got automatic British citizenship,like it or not , that is the law.
Obviously if his parents were Nigerian he would not get British citizen ship no matter if they were married or not!
