Divebuddy, assuming you're referring to the Speedwatch volunteers, often pilloried in the pub by the same people who complain about cars speeding through narrow lanes, their powers to report are widening. I fail to see why they have to put out massive signs to warn the idiots to slow down for a couple of hundred metres, the speed limit is posted already.
In addition, if there are reported speeding incidents above a certain number within a month then the police will set up their own enforcement and those are legally binding.
Anyone can't do it, they have to undergo a screening process through the police and give up a lot of time, in addition to standing on the side of the road in all weathers, to initial training and up-dating.
The offence was 'Causing Death by Dangerous Driving' NOT using a phone while driving. 'Death by Dangerous' is a FAR more serious offence.
I agree that using a non hands free phone while driving should be a year's ban as Drink Driving is. But you can't make it an 'instant ban' as everyone is entitled to a fair trial no matter what the situation.
Why do you mention that the driver was Polish ? his nationality has nothing to do with the offence.
I see at least 10 people a day driving while using a mobile phone, School run Mum's and 'White van men' are the worst offenders.
A 'school run Mum' drove head first into me on my side of the road! She told me she was late so had to phone the school to say she was on the way. She ended up a lot later and had to pay all the cost of the accident.
She got away without being charged for driving while using the phone though.

So you are saying anyone can still check on the insurance part divebuudy. Yes I suppose they can provided they are prepared to sign that declaration which makes it clear they shouldn't be asking. I'm not sure if there are any sanctions though or ways of checking. Maybe you know more about this

If someone is using a car as a weapon to intentionally kill or injure someone, they can be charged with GBH, Attempted murder, manslaughter or murder.
The intent to cause harm is what puts it out of the 'accidental' category.
So killing someone by intentionally driving a car at them will result in life in jail!

It is only for your own vehicle but there is no way to check it is your car as you don't have to give ID. You can't use this to report a car to the police.
