The conviction is for using racist language NOT the video.

I dare say there are lots of things I (we generally?) deserve[i to be punished for. What they all are, how and to what degree we should be punished for them seems a bit of a task better left to God Who, we're told, will work all that stuff out and dispense perfect justice on the Day of Judgment.

Dark humour should not be a custody issue. It's not racist in intent if said in jest to a dog. It wasn't wise but nothing in itself for authorities to waste public money on. At most, after being daft enough to stick it on the web, a copper giving him a stern lecture should be sufficient. Plus a removal request to whatever website (YouTube I assume).
