At least for the time being, there is a Supreme Court majority for the death penalty, so that every case that comes before review there currently is rapidly dismissed in favour of killing somebody. Presumably the reason is that it is judged to be Constitutional -- in which case, Biden if he wants to achieve anything on this front would need to lead a push to get Congress to introduce an Amendment that has the support of 34 States.
