How did Associated Newspapers get hold of her letter in the first place?

As I understand it, the Duchess elected to have the case heard by a court offering an 'instant' decision, to avoid the delays, and this is why the case has been heard and settled now.

I fail to see how Thom's Markle handing over a letter in his possession to the mail, entitles the Duchess of Netflix to claim ownership of the copyright? Unless the letter included a footnote to this effect.
But once again the poor dear has had her cherished privacy compromised.

You may fail to see it, but the judge clearly did not, and his opinion carries rather more weight I fancy.

Hate to disappoint enemies of a free press but Associated Newspapers and other newspapers have insurance against this eventuality. It commonly covers libel, privacy, and contempt of court.

As I read it the copyright and data protection elements of the case are still to go to trial, this is just the privacy part of the claim.
