The initial reaction seems to be focusing on perceived errors in the papers-serving process.
It's intersting that the lawyers are looking at this as a defence, rather than coming at this from a perspective of innocence which they can prove in court.
Maybe because he isn't - and they can't?

In the States, getting the facts down as to whether there is a bona fide case and that due process has been followed is crucial - this comes before the meat of the case and a huge number of cases never make it through as the judge dismisses them - or sometimes in lesser cases offers a resolution process - such as anger management or whatever without it going on the record.
