Should she/he have been sent to jail?

Just because jail would have been an “appalling experience” for her, and she would have had to serve her sentence out in a male prison, was it any reason for her not receiving a prison sentence?
If she is legally a female, why would she have to be sent to a male prison? If it is her safety they are concerned about, why not be sent to a female prison?.

Defer the sentence because of cosmetic surgery? Wouldn't this then open up a can of worms with every convicted prisoner now saying that they need liposuction, a tummy tuck or a nose job and can't go to jail this week?

Was very down a couple of weeks ago feeling I would never get fit again.
Sort of turned a corner with slight but growing improvement in mobility. Have a weekly physio class which is helping and I am managing much longer walks with fewer problems.
Still very swollen though. It has to improve before the autumn because my son's size 12 sandals are all I can get on my left foot!

So what if this person WAS to receive a hard time in prison?
It comes with the territory, if you can't do the time don't do the crime
It would certainly make he/she think twice before downloading indecent images of children again - which is what prison is designed for (deter offenders from re-offending)

It is cosmetic, just under as different name. Will gender reassignment surgery physically help the quality of life for those that undergo it? No. Is their need to be another gender life threatening? No. Can they not wait till after their sentence to continue with their gender reassignment surgery? Yes. So why should their sentence be deferred?
Iv'e met many pre op transexuals and they've all agreed that they would feel better and normal psychologically once the op was done. Which tells me that this is indeed cosmetic.

It does get that way. I must have a few days each month where I think it will never improve. You just have to try and stay positive (not always easy). I have finished my physio now - they can't do nay more for me which is a shame. I begin an exercise class tomorrow to help with strengthening my ankle so that shall be a painful experience =)
I have started looking into getting back into work now as I can walk a fair distance and stand etc... The pain has not improved but it's early days this time round so we shall see.
With regards to shoes I own now five extra pairs and they are in three different sizes lol, dependant on how swollen my ankle is =)

It's a matter of proportionality JL.
So there isn't one law for some and one law for others as you say.
If a hetero still-the-same-body-they-started-with person is sentenced to x years; then a transgender person who committed exactly the same offence should also be sentenced to x years.
Not x years with an extra measure of GBH, torture and injury when their offence was identical.

you don't seem to understand the meaning of the word 'cosmetic'.
it pertains to appearance and looks.
If you've met pre-op people you should know that gender reassignment is about someone's sense of who and what they are.
I've met deaf people who manage very well as they are but tell me they will feel better and normal psychologically if they have a cochlear implant. Indeed I have met deaf parents who don't want their children to have the op because it will deny 'who they really are'.
Whilst deaf people can live excellent lives, many do not feel defined as deaf, they want to change themselves to hearing id surgery will permit. It's the same with many other conditions.

Well, if by some quirk of nature you woke up tomorrow and your body had transformed into a woman's body; would that affect your quality of life or well-being? I suggest Yes.
Would it be life-threatening? I think suicide or a rapid decline might result if you had no access to medical assistance.

But I still think that if someone believes they are trapped in the wrong gender body and psychotherapy cannot shake that, there is probably a genetic (and therefore Physiological) problem and the seriousness of that is in a different league to wanting a flatter tummy, bigger boobs or a nicer shaped nose.

I know someone who was born male and fathered a son. Decided to go through gender re-assignment in Thailand, had tackle removed and breasts implanted. Retuned to UK and has been legally reclassified as a woman. Requires hormone treatment to inhibit facial hair growth and other male traits. Under EU law must be accepted as woman and therefore entitled to compete in women's sporting competitions. "She" recently won the Senior English Womens Golf Championship. Crazy world huh?
