zapped froo the answers for a change

are you converting ? from DLA
or a new applicant ? - or reassessed from PIP

anyway - I wonder why I am posting as by contrast to the other posters I HAVE exp of appeals

so long as you arent out of time - when it is a non starter
then you must appeal within their system and
ffollow their appeals process

which is to get the mandatory letter ( wh s/o mentioned above) and follow the rules thereafter

60% chance of success if you have been deprived of PIP or failed to convert from DLA

go for it

I had a home appeal and you have to score 20 I think
and she was full of crap like
o lets see what sight you have from the cancer you say you have got

and I was going like - "you do have my letters from the Christie?" (famous cancer hospital which you only get into if you are incurable) - I didnt say that last bit

and she said - oh yes I have them !

and I was going like: 'well I dont say I have cancer, I have cancer'

(and she did not say the zippy AB all-use crushing one liner - if you say so!) but I was ready for it and holding out more copies of the letters)

and then mid sentence she said that it was all right she was going now !

and I havent been able to identify what it was that tipped the balance.,

anyway keep appealing - our masters who rule us so wisely, seem to rely on appeal fatigue

dont let this get you down too much
Hi Emmie, Great answer from Peter.
My son is also waiting, any day now. He is changing over from DLA.
Yes, appeal, appeal, appeal.
Best wishes and merry Christmas. XXX
Don't know anything PIP appeals but just looked on the Disability Rights website and that states that 75% of appeals are granted so get as much advice as you can and go for it. Don't let them grind you down and good luck.
Yes, "Nils illegit corrundum," (don't let the bar stewards grind you down).
I have no personal experience of PIP but I do have benefits knowledge.

The decision should explain how they decided how many points to award but some are more detailed than others.

It would be worthwhile contacting DWP to ask for a copy of the assessment as it's not unknown for incorrect information to be noted in the report.

Have a look at what all was written, identify any inaccuracies and include this in the Mandatory Reconsideration (MR).

If the original decision is not changed, DWP has to explain why. You can then appeal to HM Courts &
Tribunals Service (HMCTS) who will then send a copy of your appeal to DWP. They will look again at the decision and change it if appropriate.

If they cannot change the decision, they will write an appeal submission to HMCTS and send a copy to you. An indepdndent tribunal then looks at the case again.

Anyway, go for it and good luck!
