I think the words spoken were accepted, but the magistrate couldn't be sure it amounted to racial abuse. It must be the way Terry tells 'em.

The FA obviously think they are better qualified to judge the case than a court of qualified experts in their respective fields.

Its all relative, he is an expert compared to a lay person. There was a lip reading expert, various legal counsel etc etc.
the magistrate made his decision based on the evidence offered, so he cant really be blamed if people didnt get the result they "expected".

hes certainly more qualified than any of the numpties at the FA

I've just seen the footage and it's hilarious. The bit where he's supposed to say 'I never called you a ' is completely hidden behind Ashley Cole's head - ie non-existant.

The only only words you see him say are the offending ones.

I'd still like to know why Roy Keane hasn't been charged with assault yet though. It seems worse than what Terry did.

The FA doesn't have to be sure beyond reasonable doubt, however, and can thus come to a different decision on the same evidence, if they so wish.

they don't have more power than a court of law, just different evidential standards - the same standard as courts that hear civil cases.

I'm fairly sure Mr Terry DID do it.

His defence is totally implausible and unconvincing.

But because we can't hear the sound, reluctantly, we have to find the racist adulterer "Not Guilty"

As he left the court room, the Magistrate was heard to crack the gag ...
