It is a Catch 22 situation, and a legal challenge is needed to let the Courts decide. Both sides are claiming they can do it, the UK Government are claiming they can block it, so there is a conflict of interpretation that needs to be sorted out by the constitutional lawyers.
So The First Minister must go ahead and proceed with plans for a referendum, and Bozo the Clown must take her to Court to get the impasse sorted.

It appears that the law is undefined, unless less you can post some legalese that says it definitely would be illegal?

IndyRef1 was legal, so I don’t see how IndyRef2 could be illegal. Sturgeon said the first Ref was a ‘once in a lifetime’ opportunity, but that has no relevance in law. It would be another example of a politician changing their mind rather than breaking any statutes.

They could hold an "advisory" referendum but a binding referendum would need an order under section 30 or an amendment to the 1998 Scotland act. End Of.
